Epping man seeks clarity on winter parking ban
EPPING — A local resident will take his cause to his fellow citizens, after a talk with the Board of Selectmen revealed varying interpretations of an ordinance regarding downtown parking.
Michael King of 110 Main St. appeared before the board to revisit the issue of downtown overnight parking, after discussing it before the board at its July 11 meeting. King wants to purchase the property at 15 Water St., Tax Map 26, Lot 165, the former Bea's Restaurant. King wants to turn the building into apartments, but is concerned that prospective tenants will have no place to park, and wants to rent spaces in the municipal parking lot across the street.
King is planning to market the units as "workforce housing," at an average rent of $600 per month for a one-bedroom unit. He can't charge more, he said, because there is no private parking.
The issue hinges on a 2003 regulation voted in by selectmen as a "Parking Regulation for Snow Removal Operations." The regulation reads as follows: "It shall be unlawful for any person having custody, control or ownership of any vehicle to park or cause to be parked, at any time, between the hours of 11 p.m. and 6 a.m. and during any snow emergency on any public street or highway or any area maintained and owned by the Town of Epping so that said vehicle interferes, or would interfere with snow plowing and/or snow removal operations of the town Highway Department between the dates of Nov. 15 and April 15 of the subsequent year. The Town of Epping Highway Department shall have the authority to declare a snow emergency."
King interprets the regulation to mean that parking is allowed except during snow removal times. Selectmen at the Aug. 8 meeting gave a general consensus that it means all winter, snow or no snow.
At the Aug. 8 meeting he passed out a copy of the 2003 ordinance and said, "This is what you voted on. The issue was snow removal. I would like a definitive answer."
Selectman Tom Gauthier, who was also a selectman in 2003, said, "What I was voting on was a policy throughout town. You can't pick and choose."
Chairman Karen Sott-Falcone said, "You can't go to bed at night and say, 'It's not going to snow tomorrow.'"
Gauthier added, "The ordinance has been there many years. Now all of a sudden it's an issue?
