When I first read that media mogul Rupert Murdoch had closed down his sensationalist British tabloid News of the World, my first reaction was, “Good riddance!” But I’m no longer rejoicing — the scandal around the now defunct daily’s unscrupulous journalism will encourage government controls of the media world-wide.
Ecuador’s El Universo newspaper will appeal a recent court decision sentencing three executives and a former editor to three years in jail and $40 million in fines for libeling President Rafael Correa. But one of the newspaper’s owners said the judicial system is too politicized to expect a fair trial.Correa is also appealing the ruling, as he seeks the full $80 million in damages he requested.
The fight broke out in February, when Emilio Palacio, the editor of the opinion pages, wrote a column accusing the president of ordering his troops to open fire on the hospital were he was briefly held hostage by protesting police in 2010. The column, which referred to Correa as a “dictator” throughout, also suggested the government was covering up the identities of the true trigger-men that day.
In March, Correa sued for libel and defamation.
On Wednesday, Judge Juan Paredes ordered Palacio and three of the newspaper’s executives — Carlos, César and Nicolás Pérez — to pay $30 million in damages and serve three years in jail. The newspaper is responsible for an additional $10 million in damages.
The Inter American Press Association called the decision a “serious blow” to freedom of information.
“This confirms to us once again that [Ecuador’s] government continues with its systematic and hostile campaign to do away with the independent press and establish, by law or through the courts, ownership of the truth that all the Ecuadorean people must swallow,” IAPA President Gonzalo Marroquín said in a statement.
Nicolás Pérez, one of the paper’s owners and a defendant in the case, said the newspaper will appeal the ruling, but he fears the high courts have their hands tied.
During a May referendum, Correa won the right to restructure Ecuador’s judicial system by creating a commission that will appoint new judges.
“The judges that are in the courts now, want to be a part of that future system and we assume that they won’t dare rule against the government,” Pérez said. “This case has a chilling effect not just on media outlets but on the judges that want to keep their jobs.
