City Council: Beach trash compactor must go

PANAMA CITY BEACH — The City Council has ruled that a beach resort’s noisy and smelly trash compactor must be removed from a residential area.

The city’s Planning Board previously had determined that the large trash unit on Sands Street and owned by Celadon Beach Resort violated city zoning ordinances, and the resort took the decision to council members in their position as an appeals board.

The problem, as council members saw it, was that the resort was in one property zone, south of Front Beach Road, and the compactor was in another, north of Front Beach Road, Mayor Gayle Oberst said Tuesday.

Nearby residents had complained about the smell and noise of the trash unit, especially in hot weather, while the resort had offered to put up buffers.

In addition, the resort argued that having daily garbage trucks at the resort would tie up traffic along Front Beach Road. The Celadon building pushes up close to the tourist-heavy roadway.

Oberst said the decision came down to whether the particular ordinance applied to Celadon, which originally moved the compactor to its present condition because the garbage disposal shutes in its primary building were too small.

The current location of the compactor is zoned as a multi-family residential district (R-3), a zone that also includes schools and churches. The Celadon’s 193-unit resort is located in the tourist district (T-2).

Carting the trash across zones to a compactor sitting alone without its primary user is not allowed, the Planning Board earlier decided, a decision with which the council concurred.

“It’s just not a use that’s permitted,” Oberst said of the compactor’s location.

Between the Planning Board’s and City Council’s decisions, city building and planning director Mel Leonard had taken the issue to the city’s Board of Adjustments, which had upheld the Planning Board.

Leonard said the current legal maneuvering concerned whether the appropriate ordinance applied to Celadon. Going forward, Celadon still can ask for a variance from the ordinance or appeal the current council decision to the courts. Meanwhile, the compactor stays where it is.

“We can’t make them move it until everything is exhausted,” Leonard said.

Oberst said Tuesday she was sympathetic to the resort’s argument about excessive garbage trucks on Front Beach Road, an important tourist corridor. The council may want to tweak the ordinance in the future, but that won’t help Celadon now, she said.
